Anreisebestimmungen

Flug

Der Veranstalter trägt die Reisekosten, Flug hin/retour und Taxi. Der Flug wird von der Agentur in Absprcache mit dem Künstler gebucht und dem Veranstalter in Rechnung gestellt. Diese ist vom Veranstalter binnen 4 Tagen zu bezahlen um den weiteren zeitlichen Ablauf nicht zu gefährden. Zusätzlich sind Beförderungen im Veranstaltungsort für den Künstler kostenfrei.

Unterbringungsbestimmungen

Der Veranstalter hat für den Zeitraum von An- bis Abreisetag je ein Doppelzimmer auf den Namen des Künstlers mit “Late check out time” zu buchen und zu bezahlen. Hotelkategorie: fünf Sterne (TV, Wlan, Telefon, WC, 24 Stunden Roomservice, Minibar und Dusche/ Bad). Die Hoteladresse ist der Agentur unverzüglich zu übermitteln.

Verpflichtungen des Veranstalters


  • Gewährleistung der Sicherheit des vom Künstler mitgebrachten Equipments in der Zeit von Ankunft bis Abreise. Bei Diebstahl oder Beschädigung (auch durch Dritte, etc.) haftet der Veranstalter für den entstandenen Schaden.
  • Bereitstellung von 3 Pioneer CDJ 1000 CD Playern, 2 Technics Plattenspielern (MK 1210), 1 Pioneer Dj M-800 Mischpult (Crossfader, dreifach EQ/Gain pro Kanal), und zwei Monitorboxen (getrennte Lautstärkenregelung).
  • Anwesenheit eines Tontechnikers welcher bei technischen Komplikationen für Behebung sorgt, bzw. für die einwandfreie technische Übertragung zuständig ist.
  • Absicherung der Bühne während der Performance.
  • Bereitstellung eines Backstage-Raumes mit Speisen und Getränken während der Veranstaltung.
  • Anwesenheit einer Ansprechperson (Stagehand) für den Künstler, welche speziell während der Performance für Getränke, Handtücher, etc. Sorge trägt bzw. beim Transport der Platten hilft.
  • Intensive Bewerbung des Künstlers und des Vermittlers (Titan Production) mit Logo auf allen Drucksorten, bzw. nach Möglichkeit in Rundfunk und TV. 3 Exemplare des Flyers/Plakates sowie der ev. Merchandise Produkte sind der Agentur vor der Veranstaltung zu übermitteln.
  • Zukünftige Anfragen für das Engagement des Dj’s bzw. Live Act’s auch über die Bookingagentur und auf keinen Fall über den Dj, bzw. Dritte laufen zu lassen.
  • Zeitliche Einteilung der Perfomance zwischen 22.00 und 06.00 Uhr.
  • Aufzeichnungen der Performance im voraus mit dem Künstler abzusprechen und nur mit schriftlicher Bestätigung.
  • Ein zu bestimmendes Kontingent an Freikarten (+ V.I.P., Backstage,..) zur freien Verwendung.
  • Die Veröffentlichungen (Releases) von Agentur-Künstlern auf allen Drucksorten mit zu bewerben.
  • Einen Nachweis über die ordnungsgemäße behördliche Anmeldung und Genehmigung der Veranstaltung an die Agentur zu senden.
  • Einen Drucksortenentwurf zur Überprüfung des Namens und der dazugehörigen Daten des jeweiligen Künstlers (§ 1, Punkt 1.1 und 1.2) unverzüglich an die Agentur zu senden.
  • Das Gagen- und Vertragsgeheimnis zu wahren.

Schlußbestimmungen


  • Sollte der Veranstalter oder der Künstler seinen in diesem Vertrag genannten Verpflichtungen ganz oder teilweise nicht nachkommen (z.B. Stornierung, Absage, Ausfall, nicht getätigte Zahlungen, etc.), so wird eine Vertragsstrafe in Höhe der Gesamtgage fällig. Ausgenommen sind Fälle der “höheren Gewalt”, wie sie im ABGB bzw. ÖBGB definiert sind.
  • Mehrere Veranstalter haften für alle Verbindlichkeiten zu ungeteilter Hand - auch privat!
  • Falls der Künstler infolge von Krankheit seinen Verpflichtungen nicht nachkommen kann, hat der Vermittler das Recht einen gleichwertigen DJ als Ersatz zur Verfügung zu stellen.
  • Der Veranstalter hält den Vermittler und den Künstler hinsichtlich aller Nachteile und Ansprüche, welche von ihm oder dritten Personen aus Anlass der Veranstaltung gestellt werden schad- und klaglos, dies gilt auch für alle mit der Abwehr dieser Ansprüche erwachsenen Auslagen.
  • Es wird klargestellt, dass die Agentur nur als Vermittler auftritt und für das nicht einhalten von Vertragspunkten nicht zur Verantwortung gezogen werden kann. Bei Streitfall müssen sich die beiden Parteien selbst einig werden.
  • Der unterschriebene Vertrag ist unverzüglich an die Agentur zurückzusenden. Sollte der Vertrag nicht innerhalb von 7 (sieben) Tagen eingegangen sein, so ist der Vertrag nichtig und der Künstler kann anderwertig verbucht werden.
  • Durch diesen Vertrag wird weder ein Arbeitsverhältnis, noch ein einem Arbeitsverhältnis ähnliches Vertragsverhältnis zwischen den Vertragsparteien begründet. Die Ausländersteuer hat der Veranstalter in jedem Fall selber beim zuständigen Finanzamt abzugeben.
  • Bei Verzug von Zahlungen werden 14% Verzugszinsen in Rechnung gestellt.
  • Dieser Vertrag dient nur dem Geschäftsabschluss und hat als Rechnung keinerlei Gültigkeit.
  • Zusätzliche Abmachungen müssen schriftlich verfasst werden.
  • Mit der Unterschrift erklären sich der Künstler und der Veranstalter mit allen genannten Punkten einverstanden.
  • Die künstlerische Gestaltung bzw. die Art und Weise des Auftritts obliegt zur Gänze dem Künstler.
  • Es gelten die allgemeinen Geschäftsbedingungen von Titan.
  • Der Gerichtsstand ist Wien; es gelangt österreichisches Recht zur Anwendung.

Travelling Policy

Travelling

The promoter pays the costs (flight, cab,...). The flight will be arranged from the agency and has to be paid from the promoter within 4 days after receiving the invoice in order to guarantee that the timetable can be realised. All transfers in the city of the event has to be paid and arranged by the promoter as well.


Accommodation

The promoter has to book and pay a double room with “late-check-out” out for the time from the arrival until the departure of the artist under the artist’s name. Category: 5-stars (TV, Wlan, telephone, minibar, 24 hour room service, WC and shower/bathroom). The address of the hotel has to be sent to the agency immediately.

Obligations of the promoter


  • Guarantees for the safety of the artist’s equipment for the time from the arrival until the departure of the artist. If the equipment gets stolen or damaged (even by a third person) the promoter will be liable for it.
  • Three Pioneer CDJ 1000 CD player, 2 Technics turntables (MK 1210), a Pioneer Dj M-800 dj-mixer (crossfader, triple EQ / one gain per channel), and two monitorboxes (separately adjustable) on stage.
  • Guarantees the presence of a sound engineer who will help to clear any kind of technical problems and secures the technically unobjectionable transfer.
  • Secure the stage during the performance.
  • Arrangement for a backstage room with food and beverages during the event.
  • Guarantees for the presence of a person in charge (stagehand) who will cater for beverages, towels, etc. during the performance and who helps to transport the record cases.
  • Intensive publicity with the brand of the artist and the agency (Titan Production) on all printed matters or if possible on radio and TV. Three sample copies of flyer/leaflets/posters and other merchandise products if produced have to be sent to the agency immediately.
  • Future requests and inquiries concerning the booking of the DJ or the live act even over the agency must not be addressed to the artist or a third person.
  • The performance will take place between 10.00 pm and 06.00 am.
  • Any recording of the performance has to be agreed with the artist.
  • Makes a certain contingent of free tickets (+ V.I.P., Backstage,..) available for the artist.
  • Advertising for the releases of the agency-artists on all printed matters.
  • To send the evidence that the event is officially reported and granted to the agency immediately.
  • Also to send a flyer/leaflet layout to the agency to enable the agency to review the artist’s name and and the appropiate facts.
  • To keep the fee and the contents of the agreement secret.

Final terms


  • In case the promoter or the artist do not perform one or more of the described obligations (e.g. cancellation by the promoter or the artist, falling out, not effected payment, etc.) a penalty to the amount of the complete fee should become due. Excepted are cases of force major as those are described in the ABGB resp. BGB.
  • Several promoters are indivisible liable and also private responsible.
  • In case the artist cannot perform the obligations because of illness (with doctor’s certificate), the agency has the right to make an equivalent DJ available.
  • The promoter has to hold the agency and the artist harmless with regard to all disadvantages and claims that are asserted by him or a third person because of the event. This is as well valid for the expanses concerning those claims.
  • It is pointed out that the agency appears exclusively as the negotiator. Consequently the agency is not liable for any non performance of the agreement’s obligations. In case of litigation the two parties have to reach an agreement by themselves.
  • The signed agreement has to be sent to the agency immediately. Should the agreement not arrive within 7 (seven) days, it is invalidated and the artist can be booked in other manners.
  • This Contract does not correspond with a contract of employment or any other relationship through a contract between the contract partners.
  • This agreement is only valid as a transaction, not as an account or invoice.
  • In case of default of payment 14% interest for delay can be charged.
  • Additional obligations have to be made in explicit and written form.
  • By signing this agreement the promoter and the artist give their consent to it.
  • The artist is free to arrange totally the way of art performance.
  • Any disputes arising hereunder will be settled before a competent Vienna court of law.
